Key Legislation:
From 2004 to 2014, West Virginia was consistently ranked as a Judicial Hellhole, a term meaning that judges applied laws and court procedures in an unfair and unbalanced manner, typically against defendants in civil lawsuits. However, over the last decade, we have passed legislation to reform our legal system.
SB 275: Created the Intermediate Court of Appeals
SB421: Limited punitive damages to the greater of four times the amount of compensatory damages or $500,000.
HB3270: Amended the deliberate intent statute to limit noneconomic damages to $500,000.
